On Tuesday, February 25th, Congressman Chris Gibson (R-NY) filed HR 4083, the “Distillery Excise Tax Reform Act of 2014”. The proposed legislation is the updated version of the original excise tax reduction bill proposed by former Congressman Maurice Hinchey known as HR 777.
The new legislation, filed in support of the rapidly expanding craft distilling industry, is meant to create distiller tax parity with craft brewers and winemakers—two groups that have long enjoyed an excise tax schedule that recognizes and supports domestic manufacturing growth and the local economic benefits that result from an equitable tax structure.
If enacted, the proposal would create a rate of $2.70 per proof gallon for the first 100,000 proof gallons produced annually. Beginning with the 100,001st proof gallon, the tax would then revert to the current full rate of $13.50 per proof gallon.
Passage of this legislation will have a substantial impact on small distillers, allowing them greater access to expand operations, create jobs, and further benefit local communities. It will not be successful without a significant investment from the craft distilling industry in educating their local congressional representatives about the benefits, and seeking their active support and help towards it’s passage.
